Preamble:
The Terms and Conditions (hereinafter referred to as “T&C”) govern the rights and duties of The Brillianthwaa Enterprise (hereinafter referred to as "We", "Us" or "Ours'') and its Purchasers (''You"). By placing a pre-order and/or making a purchase through this Website, you thereby accept and agreed as follows:
Interpretation
"Agreement" refers to this T&C agreed by the Contracting Parties;
“Carrier” refers to the third-party responsible for the delivery of your product purchased through our Website;
"Complaint Period" refers to the two-days period commencing from the date the delivery is completed;
“Contracting Parties” refers to both you and us;
"Copyrighted works" refers to all original artistic works such as paintings, drawings and/or designs created by us and the reproduction thereof on articles of goods such as tee-shirts;
“Details” refers to the personal information we collected from you for the purpose of performing this Agreement which includes but not limited to name, delivery address, contact number and email address;
“Product(s)” refers to finished article(s) of goods which consist of the reproduction of our copyrighted works;
"Purchased Product" refers to order which you have duly paid;
"Supplier" refers to the third-party we engaged for the supply of articles of goods such as tee-shirts, on which we reproduce our copyrighted works;
“Website” refers to our registered domain name - brillianthwaa.com
“You” refers to any person who place a pre-order or purchase any of our products of Artwork through this website;
1. Products
1.1 Our products are the reproduction of our copyrighted artistic works which are created.
1.2. Articles of goods used in our products are supplied from a third party. You may find the details of the materials in the description provided on the Website should you have any allergies concerns.
2. Representation And Warranty
2.1 All products sold are of merchantable quality and as per described on the website. In case of defective product, please refer to our Return and Exchange policy for detailed guideline on the procedures involved;
2.2 We will manage your Purchased Product including its delivery according to the Details you have provided. We shall not be liable for any undelivered product due to any errors and/or mistakes in the Details so provided;
2.3 It is your duty to ascertain the type and quality of the Product upon receiving and within the “Complaint Period". Otherwise, you are deemed to satisfied with the Product received.
3. Complaint and/or assistance
3.1 Any defect in the Product shall be immediately notified to us in accordance to the guideline provided under the Return and Exchange Policy;

4. Payment
4.1. To complete payment for your order, please follow our detailed payment instructions which will appear on our Website once you have confirmed your order. Unless otherwise agreed, the payment currency shall be in Ringgit Malaysia (RM).
4.2 Please refer to our Shipping and Delivery policy for more details regarding the process involved after you have completed your payment.
5. Indemnity
5.1 You agree to indemnify us against any liabilities or damages incurred in connection with or arising from the services rendered by any third parties to this Agreement namely, the Carrier and the Supplier which includes but not limited to damage on packaging, stolen package during shipment and delivery, and unfinished sewing of clothing article.
5.2 Further, you also agree to indemnify us against any liabilities or loss suffered arising from your allergy, existing or otherwise, towards any of the materials used in our products.
6. Variations
6.1 We reserved the right to change, add or otherwise modify our T&C without giving you any prior notice on the same.
7. Severability
7.1 If any provisions of this T&C is held to be unenforceable or invalid for any reasons, such unenforceability or invalidity shall not affect the remaining provisions hereof and the remainder of this T&C shall continue in full force and bind the Contracting Parties accordingly.
